Anaxer Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Anaxer platform, including the Anaxer dashboard, API services, streaming endpoints, historical data, and webhooks (collectively, the "Services").

By creating an account, accessing the API, or using any part of the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use the Services.

1. Important Terms

These Terms include provisions that affect your rights and responsibilities, including:

  • Disclaimers (Section 13)
  • Limitations of Liability (Section 14)
  • Your responsibility to indemnify Anaxer (Section 12)
  • Binding dispute resolution under Australian law (Section 16)

2. Your Permission to Use the Services

Subject to these Terms, Anaxer grants you a limited, revocable, non-exclusive, non-transferable license to access the Services.

Everyone must accept these Terms to use the Services.

3. Conditions for Use

Your permission to use the Services is subject to the following conditions:

  • You must be 18 years or older.
  • You may not use the Services if Anaxer notifies you directly that you are prohibited.
  • You must comply with Acceptable Use (Section 5) and Data Usage Rules (Section 6).
  • You may not access the Services if doing so is prohibited in your jurisdiction.

4. Account Registration

Some features require an account.

  • To create an account, you must provide a valid email address and keep it up to date.
  • You are responsible for all activity under your account unless you notify Anaxer of suspected compromise.
  • You must maintain the confidentiality of your password and API keys.
  • Anaxer may suspend or terminate your account if you violate these Terms.

5. Acceptable Use

You may not:

  • Use the Services for any illegal purpose.
  • Attempt to access other users' accounts or API keys.
  • Stress-test or overload Anaxer's infrastructure.
  • Circumvent rate limits or authentication mechanisms.
  • Interfere with or disrupt the Services.
  • Upload malicious code, viruses, or bots.
  • Use the Services to engage in fraud, money laundering, or other harmful behavior.
  • Misrepresent your affiliation with Anaxer.
  • Resell or redistribute Anaxer's raw data, streams, or API results unless expressly allowed by Anaxer in writing.

6. Data Usage Rules

6.1 Raw Data Redistribution

You may NOT resell, redistribute, or repackage Anaxer's raw API data, streaming data, or historical datasets.

6.2 Derived Data

You may create derived datasets, analytics, dashboards, insights, or products so long as:

  • They are not a direct substitute for Anaxer's API or data services; and
  • They do not expose raw Anaxer response data to external users.

This is equivalent to Bitquery's model.

6.3 High-Frequency Systems

You may use the Services for automated systems (bots, agents, trading systems) provided you remain within your plan limits.

7. Pricing & Billing

7.1 Plans

The Services offer multiple subscription plans with varying limits (API calls, RPM, stream access, connections).

Plan details are listed at https://anaxer.com and may change over time.

7.2 Payments

You may pay using:

  • Credit/debit cards via Stripe
  • Supported crypto assets

7.3 Billing Cycle

Subscriptions are billed monthly or annually, depending on your selection.

7.4 Refunds

Anaxer offers a standard refund policy:

  • Refunds may be granted for billing errors or service deficiencies at Anaxer's discretion.
  • No refunds will be provided for misuse, overages, or failure to cancel before a renewal date.

8. API Keys & Security

  • You are responsible for keeping your API keys secure.
  • You may not share, sell, or publicly expose your keys.
  • If your key is compromised, you must notify Anaxer immediately.

9. Usage Limits

Your subscription includes rate limits, monthly API call quotas, and stream connection limits.

Anaxer may throttle, restrict, or suspend access if:

  • You exceed your plan limits
  • Your usage negatively impacts system performance
  • You attempt to bypass limits

10. Webhooks

You are responsible for ensuring your webhook endpoints:

  • Respond within reasonable time frames
  • Are secure and properly configured
  • Can handle the volume of data you subscribe to

Anaxer is not liable for failed or delayed webhook delivery caused by your systems.

11. Intellectual Property

Except where stated otherwise:

  • Anaxer retains all ownership of its platform, APIs, datasets, aggregation logic, streaming technology, and infrastructure.
  • You retain ownership of any content, code, or applications you build using Anaxer data.
  • Nothing in these Terms transfers ownership of Anaxer's intellectual property to you.

12. Your Responsibility (Indemnification)

You agree to indemnify and hold harmless Anaxer from any claims, damages, or costs arising from:

  • Your breach of these Terms
  • Your misuse of the Services
  • Any legal or regulatory issues caused by how you use the data

13. Disclaimers

You accept all risk associated with using Anaxer's data.

Anaxer provides the Services "as is," without warranty, including:

  • Accuracy of blockchain data
  • Completeness or timeliness of streams
  • Suitability for trading or financial decisions
  • Availability or uptime of any endpoint

Blockchain data may contain errors, delays, or inconsistencies not controlled by Anaxer.

14. Limits on Liability

To the fullest extent permitted by law:

  • Anaxer is not liable for trading losses, financial losses, system downtime, or decisions made using the data.
  • Anaxer's total liability for all claims is limited to the greater of AUD $100 or the fees you paid in the prior 30 days.
  • Anaxer is not liable for indirect, consequential, or punitive damages.

15. Feedback

If you submit feedback, suggestions, or ideas, you grant Anaxer full rights to use them without compensation or obligation.

16. Dispute Resolution

16.1 Governing Law

These Terms are governed by the laws of Australia, specifically the laws of New South Wales, without regard to conflict of law principles.

16.2 Venue

You agree that any disputes may be heard only in courts located in New South Wales, Australia.

16.3 Arbitration

Except for injunctions or intellectual property claims, disputes will be resolved through binding arbitration conducted in Australia under standard commercial arbitration rules.

Class actions are not permitted.

17. Termination

You or Anaxer may terminate your account at any time.

Upon termination:

  • Your permission to use the Services ends
  • Your API keys will be disabled
  • Sections relating to liability, intellectual property, and dispute resolution will survive termination

18. Changes to These Terms

Anaxer may update these Terms periodically. Material changes will be communicated via:

  • Email (if you have an account), or
  • Notices posted on the dashboard

Continued use of the Services after changes constitutes acceptance of the updated Terms.
